Trump’s National Guard Deployment to Portland Temporarily Blocked

(MENAFN) A federal judge has temporarily blocked the Trump administration’s order to send 200 National Guard troops to Portland, issuing a sharp rebuke over what she deemed an unconstitutional overreach of executive power.

U.S. District Judge Karin J. Immergut granted a two-week temporary restraining order on Saturday following a joint lawsuit filed by the State of Oregon and the City of Portland on September 28. The lawsuit challenges a memorandum signed the same day by Defense Secretary Pete Hegseth, which sought to federalize and deploy Oregon’s National Guard to Portland.

In her ruling, Immergut argued that the directive, backed by President Donald Trump, violated the constitutional balance between state and federal authority.

“This country has a longstanding and foundational tradition of resistance to government overreach, especially in the form of military intrusion into civil affairs,” Immergut wrote.

“This historical tradition boils down to a simple proposition: this is a nation of Constitutional law, not martial law. Defendants have made a range of arguments that, if accepted, risk blurring the line between civil and military federal power -- to the detriment of this nation,” she added.

Immergut, herself a Trump appointee, emphasized in the ruling that the president lacks the constitutional grounds to override a state's control of its own National Guard under these circumstances.

The move comes amid growing legal scrutiny of military involvement in civil matters. Just last month, a federal judge in California ruled that the Trump administration's June deployment of the National Guard and Marines to Los Angeles was unlawful.

The temporary block will remain in effect for 14 days as the case proceeds.
